PlanSuite Terms of Use

1. Acceptance of Terms
By creating an account, accessing, or using PlanSuite, you agree to these Terms of Use. If you do not agree, you must not use the platform.
If you use PlanSuite on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.
2. Platform Description
PlanSuite is a software platform that assists users with analysing planning information, interpreting regulatory controls, and generating structured planning reports and insights.
The platform is an assistance tool only and does not replace professional judgement or statutory decision-making.
3. Account Responsibility
You are responsible for:
- maintaining login security
- restricting access to authorised users
- all activity under your account
You must immediately notify us of any unauthorised access.
4. Permitted Use
You may use PlanSuite only for lawful business purposes.
You must not:
- reverse engineer the platform
- copy or resell it
- scrape data
- attempt unauthorised access
- build competing tools
- interfere with system operation
5. Artificial Intelligence Outputs
PlanSuite uses automated technologies including artificial intelligence. Property data and planning scheme content may be sent to third-party AI services for processing (see our AI Transparency Policy for details).
You acknowledge:
- outputs may contain errors
- outputs depend on inputs
- outputs are probabilistic
- outputs are advisory only
You must independently verify outputs before relying on them.
PlanSuite must not be used as the sole basis for legal, regulatory or statutory decisions.
6. Data Ownership
You retain ownership of data you upload.
You grant PlanSuite permission to use that data to:
- operate the platform
- generate outputs
- maintain security
- improve functionality
PlanSuite may use anonymised and aggregated data for analytics and system improvement.
We do not sell your data.
7. Availability
We aim to keep the platform available but do not guarantee uninterrupted service. Access may be interrupted due to maintenance, updates, technical issues or events beyond our control.
8. Fees
Paid features require subscription fees as displayed at purchase.
Unless stated otherwise:
- fees are exclusive of GST unless otherwise stated
- fees are payable in advance
- fees are non-refundable, except to the extent required by Australian Consumer Law
- pricing may change upon renewal with notice
9. Intellectual Property
All rights in the platform, including software, algorithms and AI systems, remain the property of PlanSuite or its licensors. No ownership rights are transferred to you.
10. Limitation of Liability
To the maximum extent permitted by law, PlanSuite is not liable for:
- indirect or consequential loss
- loss resulting from reliance on outputs
- decisions made using the platform
Total liability is limited to fees paid in the previous 12 months.
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that applies under the Competition and Consumer Act 2010 (Cth) or equivalent State or Territory legislation that cannot be excluded, restricted or modified.
11. Suspension or Termination
We may suspend or terminate access if:
- these Terms are breached
- fees are unpaid
- use creates legal or security risk
12. Changes to Terms
We may update these Terms from time to time. Continued use after updates means you accept the revised Terms.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have exclusive jurisdiction.
